Terms and Conditions for Mockup Licenses

1. Overview

These Terms and Conditions (“Agreement”) govern the use of mockups provided by Format Mockups Limited (“Company,” “we,” or “us”). By purchasing, downloading, or using our mockups, you (“User” or “Customer”) agree to these terms. All intellectual property rights to the mockups remain the property of Format Mockups Limited and are protected under international copyright laws.

This Agreement applies exclusively to the purchase, usage, and licensing of mockups from Format Mockups Limited.

2. Company Information

3. Definitions

• Mockups: Digital representations (e.g., photographs, renderings, or graphics) that are used to showcase designs, branding, or products in various contexts.

• Users: Any person or entity purchasing or using the mockups provided by Format Mockups Limited.

• License: A non-exclusive, non-transferable right to use the mockups in accordance with the terms specified in the applicable license tier.

• Standard License: For individuals and sole traders, allowing limited personal use. This is the default license that comes with all mockups purchased.

• Commercial Mini: For small to medium-sized companies, allowing multiple users within the same company. This must be purchased separately.

• Commercial Max: For large businesses and agencies, granting broader commercial rights. This must be purchased separately.

• Client: Any third party receiving services from the User.

• Exported Images: Flattened images derived from the original mockup files, shared with clients by the User without editable layers.

4. Ownership and Intellectual Property

All mockups available on this Website is owned by Format Mockups Limited. All rights are reserved under applicable copyright laws.

• The User may modify or edit the layers of the mockups as needed for their own use, within the scope of the purchased license. However, the User may not copy, share (beyond the limits set in this Agreement), translate, transform, publish, transmit, sell, sublicense, transfer, or create derivative works intended for resale or distribution without the express written permission of Format Mockups Limited.

• The User is prohibited from reverse engineering, decompiling, or otherwise attempting to recreate the mockups, either partially or fully, for the purpose of resale, redistribution, or any unlicensed use.

• The User may only share exported images (flattened images without editable layers) with their clients. Source files (including layered PSDs or other editable formats) may not be shared, sold, or redistributed.

5. License Overview

We offer three tiers of licenses for mockups: Standard License, Commercial Mini, and Commercial Max. Each license is subject to specific rights, restrictions, and limitations, as outlined below. Users must ensure compliance with the terms of the license they purchase.

• Default License: All mockups purchased from Format Mockups Limited come with the Standard License by default. If the User requires broader usage rights, they must separately purchase a Commercial Mini or Commercial Max license.

• License for Multiple Mockups: When purchasing multiple mockups, a single Commercial Mini or Commercial Max license will apply to all products in the User’s basket. The Standard License applies unless the User opts for an upgraded license.

Standard License

6. Standard License

6.1. Users:

• Intended for individuals and sole traders.

6.2. Permitted Use:

• Unlimited personal use on websites, personal social media, portfolios, and blogs.

Client Usage is limited to sole traders and client presentations only. No other client-related uses are permitted.

6.3. Restrictions:

• Paid advertising and any commercial promotional activities are not allowed.

• No resale, distribution, or sub-licensing of mockups, either in physical or digital form.

6.4. Duration:

• This license is granted for lifetime use, with no expiration or renewal required.

Commercial MINI License

7. Commercial Mini

7.1. Users:

• For small to medium-sized companies, allowing unlimited users within the same company.

7.2. Permitted Use:

• The User is allowed to use the mockups for 1 project.

Client Usage:

• 1 organic social media account for the client is allowed.

• No paid advertisements or website usage on behalf of the client.

• No print production or resale is allowed unless the client purchases their own license.

7.3. Advertising:

• Digital ads up to 750,000 impressions are permitted.

7.4. Product Use:

• The User may create up to 10,000 print items, such as cards, stationery, and other printed materials.

• Resale of these printed materials is not permitted.

7.5. Self-Promotion:

• Mockups may be used in presentations, pitches, press releases, and on the User’s own website (including e-commerce).

• Organic social media content is allowed for the User’s accounts.

• The User may use mockups in newsletters, e-commerce, and blogs.

7.6. Duration:

• This license is granted for lifetime use, with no expiration.

Commercial MAX License

8. Commercial Max

8.1. Users:

• For large businesses and agencies, allowing unlimited users within the same company.

8.2. Permitted Use:

• The User is allowed to use the mockups for unlimited projects.

Client Usage:

• Paid ads and website use for the client is allowed.

• Unlimited client social media accounts may utilise the mockups.

• No print production or resale unless the client purchases their own license.

8.3. Advertising:

• All forms of digital advertising (e.g., social media ads, Google Ads, boosted posts) are allowed.

8.4. Product Use:

• The User is allowed unlimited print runs for items such as cards, stationery, or paper products.

• For products intended for resale, the User may produce up to 1 million units.

8.5. Extended Commercial Use:

• Mockups may be used in out-of-home advertising (billboards, posters, etc.).

• Mockups may also be used in digital products (e.g., templates, apps, or games) with a yearly turnover cap of £5 million.

8.6. Duration:

• This license is granted for lifetime use, with no expiration.

Shared Terms Across All License Tiers

9. Purchasing Process

• Users can select mockups from the website and complete the purchase by providing necessary payment details via Stripe or Squarespace Pay.

• Upon successful payment, the User will receive a PDF containing a Google Drive link to download the mockups.

• The User is responsible for maintaining the security of the download link. Sharing or redistribution of the source files is strictly prohibited.

10. Discount Codes

• Misuse or sharing of discount codes is strictly prohibited.

• Each discount code is for single-use only unless explicitly stated.

• Discount codes cannot be combined unless specified.

11. Refund Policy

• All sales are final. Refunds will not be issued once the mockups have been purchased.

• Users are encouraged to carefully review their order before completing the purchase.

12. Right to Audit

• Format Mockups Limited reserves the right to audit any User’s projects to ensure compliance with these licensing terms.

• Users may be required to provide samples of their projects, including free access to restricted content for review.

• If any violations are detected, Format Mockups Limited reserves the right to terminate the User’s license and take legal action.

13. Intellectual Property and Copyright

All mockups provided by Format Mockups Limited are protected under international copyright laws. By purchasing mockups, Users are granted a non-exclusive, non-transferable license to use the mockups within the scope of the purchased license.

• Redistribution, resale, or sub-licensing of the mockups is prohibited unless explicitly granted in writing.

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

15. Modifications to the Terms

Format Mockups Limited reserves the right to amend or modify these Terms and Conditions at any time. Changes will be posted on the website, and Users are responsible for reviewing the terms periodically. Continued use of the mockups signifies acceptance of any revised terms.
